Disability Insurance Policy Claims:

Many disability insurance companies have a policy of denying claims in the expectation that a large percentage of disability insurance claimants will go away and not pursue the matter further.  The claimants who do not give up and hire a lawyer have a much better chance of receiving the benefits they are entitled to.

Disability insurance claimants who have been wrongfully denied disability benefits and are left without any assistance in their time of need, also may have a claim against their disability insurance company for breach of their duty to treat them with utmost good faith, as well as  claim for punitive and/or aggravated damages.

Disability Insurance Policies and Critical Illness Policies are ‘peace of mind’ contracts that pay you a portion of your lost income if you become “disabled” from working as a result of illness or injury, and or suffer from a critical illness, specifically listed in the policy.

These can be individual/private plans or policies (paid for privately by the person wishing to be insured) or group plans or policies (paid as part of your employment package).

In most cases, you will qualify for benefits if you are not able to perform the substantial duties of your own occupation for 24 months, and the substantial duties of any occupation after 24 months.

The denial of disability benefits is usually based on the alleged lack of medical proof of your disability and/or lack of medical attendances. Once we are retained, we can request proof of your medical disability from your treating physicians, and if necessary, send you to independent medico-legal specialists to assess and prove your disability.

Mortgage Disability Insurance Claims:

Many lending institutions require you to have this policy. The plan pays the bank if the insured becomes disabled and is unable to work.

House Insurance Coverage Claims:

House insurance covers damage to property, caused by fire, flood and other eventualities, and pays for the cost of replacement, reconstruction or repair of property affected by fire, flood or other types of  damage, listed in the insurance policy.

In many of the denials of disability, life, mortgage and house insurance policy, the insurance companies blame the victim. They make allegations of misrepresentation, they claim non-payment of premiums, and they deny compensation based on exclusion loopholes. Sometimes, they even hire private investigators to spy on the very people they promised to help in their time of need. To paraphrase Mark Twain, an Insurance Company gives you an umbrella when the Sun is shining and takes it away when it starts to rain.

If you are denied benefits, you are usually given only 1 to 3 months to appeal the decision in writing, and 1 year to commence court proceedings. As such, it is important to contact a lawyer quickly to obtain a free initial consultation.
